Many people still think that “once you sell goods, you must register your business.” In fact, the law clearly provides for certain cases where business registration is not mandatory, especially for small-scale activities with low income. Under current legal regulations, the following groups are not required to register their business.

Pursuant to Article 3 of Decree No. 39/2007/NĐ-CP and Clause 3 Article 82 of Decree No. 168/2025/NĐ-CP, the following individuals are not required to register their business:

• Peddling (itinerant trading): Buying and selling activities without a fixed location 
• Petty trading: Selling small items, with or without a fixed location 
• Selling snacks: Selling cakes, food, beverages with or without a fixed location 
• Trading by trips: Purchasing goods from other places in batches/trips for resale to wholesalers or retailers 
• Personal services with low income (the specific income threshold is determined by the provincial People’s Committee): shoeshining, lottery ticket selling, locksmith services, vehicle repair, parking services, car/bike washing, hair cutting, painting, photography, and other services.(Note: “Low income” does not have a uniform nationwide threshold but is determined by each locality.)
• Mobile business: Commercial activities without a fixed location
• Households engaged in agricultural, forestry, fishery production, or salt production

However, if individuals falling under the above groups engage in conditional business lines, they must still carry out business registration procedures.

In addition, individuals/households may voluntarily register as household businesses if they wish, pursuant to Clause 4 Article 82 of Decree No. 168/2025/NĐ-CP.
